Prices and product information.

We place great emphasis on ensuring the accuracy of all product details, descriptions, and prices at the time they are entered or updated in our system. However, please note that there may be instances where the information, including product descriptions, may not be entirely up to date at the exact moment of purchase. The confirmation of a product’s price will be made upon acceptance of your order in accordance with our Terms & Conditions.

While we strive to uphold the quoted prices, Berry’s Supplies acknowledges that market conditions may sometimes prevent us from doing so. Therefore, we reserve the right to modify product details, prices, and even discontinue items as necessary, without prior notice. Our aim is to provide the best service possible while adapting to the changing market dynamics.

Product warranty.

When goods are returned under warranty, Berry’s Supplies will repair or replace them based on the manufacturer’s conditions. The decision to repair or replace the item returned under warranty will be at the sole discretion of Berry’s Supplies. Please note that the warranty does not cover routine service work or repairs caused by misuse.

Delivery.

Unless explicitly agreed otherwise, Berry’s Supplies will deliver the goods or services to the location specified in the order, or any other mutually agreed location. The delivery of goods will be considered complete upon their arrival at the agreed location. Please note that any quoted timeframe or delivery date provided by Berry’s Supplies is an estimate only. While we will make every effort to deliver on time, we cannot be held responsible for any repercussions arising from delays in delivery. Additionally, Berry’s Supplies will not be held liable for any delivery delays caused by unforeseeable circumstances beyond our control, such as natural disasters, acts of God, etc., or if the buyer fails to provide adequate delivery instructions.

Returned or cancelled goods.

Berry’s Supplies reserves the right to apply a 25% handling charge on any returned goods. To be eligible for return, the goods must be in a saleable condition and remain unaltered. Please note that Berry’s Supplies retains the right to decline cancellation or return requests for specially ordered, specially made, large quantity, or custom-sized goods. In the event of receiving damaged or faulty goods, customers are entitled to a full refund, which includes the basic delivery cost, provided they notify Berry’s Supplies of any damages or faults within 30 days of receiving the goods.

Payment terms.

All prices are to be paid in £ sterling. For non-trade account holders, payment by credit or debit card is required at the time of placing the order. Customers with a trade account are expected to settle their payment within 30 days from the date of the invoice, unless special settlement terms have been agreed upon beforehand. In accordance with the provisions of the Late Payment of Commercial Debts (Interest) Act 1998, Berry’s Supplies reserves the right to charge interest on overdue accounts at a rate of 8% above the base rate of the Bank of England.

Liability.

Berry’s Supplies will not be held liable to the customer for any breach of implied warranties, conditions, or other terms, or any duty imposed by the laws of England, or under the explicit terms of this Agreement, for any direct or consequential loss or damage (including but not limited to loss of profit), costs, expenses, or other claims for compensation (whether arising from Berry’s Supplies’ negligence, actions of its employees or agents, or otherwise) that may arise in connection with the performance of this Agreement, unless expressly provided for herein.

Berry’s Supplies cannot be held responsible for any loss or damage resulting from the failure to promptly or completely deliver the goods or services. However, even if Berry’s Supplies has experienced delays or failure in delivery, the customer is still obligated to accept the delivery and make full payment for the goods, provided that the delivery is attempted within 10 days of the agreed-upon delivery date.

VAT.

Please note that all prices are exclusive of VAT (unless otherwise stated), which will be applied at the prevailing rate on the date of sale.

Validity.

In the event that any term in this contract is deemed invalid, the remaining terms will remain valid and enforceable without being affected by such invalidation.

Retention of title.

Title and ownership of the goods shall remain with Berry’s Supplies until full payment, including any applicable taxes, has been received from the customer. Until such payment is made, the customer agrees to keep the goods separate from other property, clearly identified as the property of Berry’s Supplies. In the event of non-payment or default by the customer, Berry’s Supplies reserves the right to reclaim the goods and enter the customer’s premises to retrieve them. The customer grants Berry’s Supplies irrevocable authority to access the premises for this purpose. Until title is transferred to the customer, the customer is not permitted to sell, transfer, or dispose of the goods without the explicit consent of Berry’s Supplies.

Collections.

If the Customer has requested the collection of goods, it is expected that they will collect the goods from Berry’s Supplies premises within 7 days after receiving notification that the goods are ready for collection. Failure to collect within this timeframe may result in Berry’s Supplies applying a daily storage charge, at its discretion.
